Terms of Service
Please read these Terms of Service carefully before using MechMap. These Terms govern your access to and use of the MechMap mobile application and related services.
1. Acceptance of Terms
By downloading, installing, or using the MechMap mobile application ("App") or any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use MechMap.
2. Description of Service
MechMap is a two-sided marketplace that connects customers seeking automotive services (oil changes, detailing, brakes, car wash, and more) with independent mobile mechanics and detailers ("Providers"). MechMap facilitates the connection but is not a party to the service agreements between customers and Providers.
3. Eligibility
You must be at least 18 years old to use MechMap. By using the App you represent that you meet this requirement and that all information you provide is accurate and complete.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@mechmap.app if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
5. Provider Obligations
Providers represent that they hold all required licenses, certifications, and insurance to perform automotive services in their jurisdiction. Providers are independent contractors, not employees or agents of MechMap. MechMap does not supervise, direct, or control Provider work.
6. Bookings and Payments
Customers may request bookings through the App. Pricing is set by Providers and displayed before booking confirmation. Payments are processed by Stripe. MechMap charges a platform service fee. Refund eligibility depends on the Provider's cancellation policy and MechMap's dispute resolution process.
7. Provider Subscriptions
Providers may purchase Pro ($29.99/month) or Featured ($99.99/month) subscription plans through the App. Subscriptions are billed monthly through the Apple App Store or Google Play and are subject to those platforms' refund policies. You may cancel at any time in your device's subscription settings.
8. Prohibited Conduct
You agree not to: • Use the App for any unlawful purpose. • Harass, threaten, or discriminate against other users. • Post false, misleading, or fraudulent content. • Attempt to circumvent the platform by transacting off-platform to avoid fees. • Reverse engineer, scrape, or otherwise misuse the App or API. • Create multiple accounts to manipulate ratings or reviews.
9. Reviews and Content
You retain ownership of content you submit (reviews, messages, photos). By submitting content, you grant MechMap a worldwide, royalty-free license to use, display, and distribute that content in connection with the App. We may remove content that violates these Terms or our community guidelines.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. MECHMAP DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. MECHMAP DOES NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY PROVIDERS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MECHMAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP OR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO MECHMAP IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold MechMap, its officers, directors, employees, and agents harmless from any claims, damages, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your interaction with other users.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property matters.
14. Changes to Terms
We may update these Terms at any time. We will notify you of material changes via push notification and in-app notice. Continued use of MechMap after the effective date constitutes acceptance of the updated Terms.
